By using DeedWorth, you agree to the terms below. If you do not accept them, please do not use the service.

Nature of the service

DeedWorth provides real estate investment tools and analyses for informational purposes. Results do not constitute personalized financial, tax, legal or investment advice. DeedWorth is not a broker, a financial institution, or an investment advisor, and does not manage any funds. Decisions you make are your responsibility; consult a qualified professional before acting.

Accuracy

We strive to reflect accurate rules and rates, but these change and may contain errors. The service is provided “as is,” without warranty of accuracy or availability. Verify material amounts with official sources and your notary, accountant or advisor.

Your account

You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for activity carried out from your account.

Acceptable use

You agree not to use the service for unlawful purposes, not to attempt to scrape its data at scale, disrupt its operation, or circumvent its security or access measures.

Restrictions

In addition to the permitted uses described above, you are prohibited from attempting to reverse-engineer, decompile, disassemble or otherwise analyze the service in order to obtain its source code, internal structure, algorithms or calculation methods.

You may not resell, rent, lend, sublicense, assign, redistribute, publish or make available to third parties our content or the results generated by the service. This restriction does not apply to the widgets we provide expressly for embedding on another site and used in accordance with their own terms, nor to share links to a card where this feature is offered by the service.

You may not use the service, its content or the results it generates to develop, train, feed, operate or commercialize a product or service that directly competes with the service.

You may not use the service to distribute or transmit content that is false, misleading, defamatory, abusive, hateful, or that infringes the rights, privacy or reputation of a third party.

It is also prohibited to transmit through the service any malicious program, virus, code or mechanism intended to disrupt, compromise or circumvent its operation, as well as to use the service to solicit third parties without their consent, impersonate an identity, or falsely present yourself as another person or organization.

You may not access, attempt to access, or use another user's data, accounts or spaces without their authorization. You also may not make available to third parties any feature, interface or access that the service does not make publicly available, or remove, hide or alter our intellectual property notices or other legal notices.

These restrictions do not confer upon you any ownership right over the information, data or other content you enter into the service, nor over your own analyses or work produced from them. They only define the uses that are prohibited to you and do not limit the rights you otherwise hold over your own data and content.

Personal information about people who are not our users

Some features let you entrust us with personal information about another person — for example a tenant named on a lease. By using them, you represent that you have a serious and legitimate interest in holding this information, that you have informed the person concerned and obtained their consent where the law requires it, and that you only entrust us with information that is necessary. You also agree to relay without delay to the person concerned any incident notice we send you about them, and to handle any access, correction or removal request they send us that we forward to you.

In return, we commit, for this information as for any document you entrust to us, to: (a) protect its confidentiality — encrypted communications, access restricted to staff who need it to operate the service, authentication required for any access; (b) use it only to provide you the service, never for a purpose of our own, except for market statistics produced from depersonalized rent amounts (improving our products and training a model remain excluded); (c) not retain it after your account is closed: you may request its permanent deletion at any time, and we act on that request within 30 days, as with your other rights (see our privacy policy).

We also commit to notifying your privacy officer without delay of any breach or attempted breach affecting this information, and to allowing them, on written notice and no more than once a year absent an incident, to verify our compliance with the above commitments regarding this information.

Organization accounts and sharing between members

This section applies once our organization accounts launch. An organization account lets several people work on the same analyses, buildings and documents.

We commit on three points, and you commit with us on the first: (a) the members of an organization belong to the same business, or are otherwise authorized to access the information placed in sharing — we do not create an organization that brings separate businesses together; (b) sharing is an explicit act on your part: nothing is shared by default, and anything you have not shared remains visible to you alone; (c) a share can be withdrawn, and we provide you the means to do so. What sharing makes visible, and what is never shared, is described in our privacy policy.

Document vault

This section applies once our document vault feature launches. By using it, you entrust us with the custody of documents (for example, leases, tax bills or invoices) that may contain personal information about third parties — including a tenant named on a lease. See also our privacy policy.

We commit to: (a) protecting the confidentiality of these documents and the information they contain; (b) using them only to provide you the service (no other purpose); (c) not retaining them after your account is closed: you may request their permanent deletion at any time, and we act on that request within 30 days; (d) notifying you if a confidentiality incident affects these documents.

In turn, you represent that you have the right to hold and upload the documents you entrust to us, and that doing so does not violate the law or a third party's rights.

Intellectual property

DeedWorth's content, tools and brand remain the property of DeedWorth. Your analysis data belongs to you.

Third-party open data

Some public data integrated into our database comes from the City of Montréal's open data and is used under the Creative Commons Attribution 4.0 International licence (licence text: creativecommons.org/licenses/by/4.0/legalcode.en). The City of Montréal does not endorse DeedWorth or our use of this data.

Limitation of liability

To the extent permitted by law, DeedWorth cannot be held liable for decisions made or losses incurred from use of the service.

Governing law

These terms are governed by the law applicable in the province of Quebec (Canada).

We may update these terms; the update date appears at the top of the page.
